9月24日消息，据外电报道，FDA今天宣布，自9月17日上次更新MDO营销拒绝令名单以来，又有28家公司被添加到其收到营销拒绝的制造商名单中。
所有收到营销拒绝订单 (MDO) 的产品都是调味电子烟产品。
目前，接受调味产品上市前烟草申请 (PMTA) 的 MDO的公司总数为 323。可在本文末尾找到按字母顺序排列的列表。
FDA 表示，MDO已涵盖近120万种调味产品，具体数量为1,167,000种。
受上市前申请的 MDO 约束的产品不得引入或交付用于引入州际贸易。如果该产品已经上市，则必须将该产品从市场上撤下或进行风险执法。
收到这些 MDO 的公司可能已经提交了其他产品（如电子烟设备、烟草味或薄荷醇味）的上市前申请，这些产品如果仍在等待中，则仍需在 FDA 进行审查。
目前，所有新被拒绝的公司都是小型制造商。自 FDA于 8 月 26 日开始发布 MDO以来，绝大多数拒绝令都流向了小公司，只有少数发布给了像 Turning Point Brands 和 AVAIL Vapor 这样的大型开放系统制造商。
一家生产封闭系统预充式设备的上市公司 Bidi Vapor 也收到了FDA的调味产品MDO。
随着第一个 MDO 于 8 月发布，FDA 还宣布了一项新标准，要求除烟草和薄荷醇以外的调味产品的 PMTA 显示足够的特定产品科学证据，以证明对成年吸烟者有足够的好处，可以克服所带来的风险。
迄今为止发布的所有营销否认都基于先前未成文的标准。
自2020 年 9 月 9 日 PMTA 提交截止日期以来，FDA 未发布任何蒸气产品的营销授权。该机构也没有对 JUUL Labs、Reynolds American、NJOY、Logic 或 Blu 的大众市场产品做出决定。
FDA 烟草产品中心主任 Mitch Zeller 表示，由于它们的受欢迎程度，这些产品将在审查过程中被优先考虑。
所有由烟草衍生的尼古丁制成的电子烟产品现在在技术上销售都是非法的，只有通过 FDA 的执法自由裁量权才能存在于市场上。这包括烟草和薄荷醇味的电子烟产品以及尼古丁袋等调味产品。
一些小制造商已经开始用合成尼古丁重新配制他们的产品，这可能会绕过当前 FDA 烟草产品的权威。目前尚不清楚该机构是否会尝试将合成尼古丁作为一种药物进行监管。
